Court System

  • The Probate and Family Court has jurisdiction over family matters like divorce, child support, custody, adoption, and abuse prevention for the family side. For the probate side, they have jurisdiction over wills, administrations, and guardianships.
  • The Juvenile Court has general jurisdiction over cases involving delinquency, children in need of services, guardianship, and violations made by youths.
  • The Housing Court has jurisdiction over nearly all matters relating to residential housing.
  • The District Court has civil jurisdiction in civil cases that do not exceed $25,000 and they deal with cases regarding small claims, mental health, domestic violence, and alcohol/drug abuse. (The Boston Municipal Court has similar duties to the District Court.)
  • The Superior Court is the last trial court (1-5 are also trial courts) that has jurisdiction over most felonies and civil actions where the amount in controversy is over $25,000. They also have the power to review certain administrative agencies.
  • The Appeals Court reviews cases from all trial courts, which includes all types of civil and criminal cases, except for cases involving first degree murder.
  • The Supreme Judicial Court hears appeals on a broad range of criminal and civil cases giving it appellate jurisdiction over all cases and they are responsible for approving the rules for the all operations of all the courts.
